- Introduction
We are Fundraising Futures Community Interest Company (trading as “Charitable Shopping”), a company registered in England and Wales with a company number of 12319823 and a registered office at One Elmfield Park, Bromley, Kent. BR1 1LU (hereafter ‘Charitable Shopping’, ‘we’ or ‘us’).
We are a non-profit enterprise focused on supporting UK-based charities and philanthropic causes doing great work around the world (“Charities” or “Charity”).
These are our standard terms and conditions (“Ts&Cs”). When you register your free account with us (your “Account”), you accept to be bound by these Ts&Cs, our Privacy Policy and our Cookies Policy. For the avoidance of doubt, references to “you” or “your” means a user of our Website who has successfully opened an Account.
- How Charitable Shopping Works
Our website (https://charitable.shopping/) functions as a donations platform (our “Website”).
Various businesses and retail affiliates use our Website to market their goods/services in the hope that you will visit their online shops and purchase their products (the “Retailers”).
After creating your Account, you will be able to click on any of the Retailers displayed on our Website. When you do this, you will be directed to the Retailer’s online shop where you will be able to browse and purchase any of goods and/or services sold by the chosen Retailer (your “Purchase”).
By having accessed the Retailer’s online shop through our Website, we will be able to track your Purchase. When your Purchase is completed, you will be free to nominate a Charity and the Retailer will pay a fee to Charitable Shopping as a “thank you” for your Purchase (the “Thank You Fee”). If you visit the Retailer’s online shop without first logging onto your Charitable Shopping Account, you will not contribute the Thank You Fee to any Charity.
If you do not choose a specific Charity at the time of registration, any Thank You Fees received by us as a result of your Purchases will be held by us until you elect the Charity you will support. If we are holding your Thank You Fees for a period of 6 months or longer, we will distribute your Thanks You Fees to a Charity of our choosing. In addition, if the Charity you were supporting leaves our platform, then your Thank You Fees will similarly be distributed to a Charity of our choosing.
Aside from the cost of your Purchase, you will not be required to pay any additional amount to contribute to a Charity.
- Registering Your Free Account
In order to register your free Account, you must complete and submit a registration form. This will require you to provide your name, surname and an email address. You will also need to create a secure password and agree to these Ts&Cs.
By registering your Account, you are agreeing that:
- you are aged 18 years or older;
- you reside permanently in the United Kingdom;
- all information you have given to us is true, accurate and up-to-date; and
- you have not previously had an account with us, which we have terminated.
Once your Account has been successfully registered, we will send you a confirmation email.
If you wish to close your Account, you may do so by completing the request form online under the ‘Account Overview’ tab and the ‘Manage Your Data (GDPR)’ sub-tab. This will generate an email to Charitable Shopping, giving us the authority to close your Account. We will then proceed to close your account and delete your data within 72 hours.
- The Thank You Fee
The Thank You Fee is calculated with reference to your Purchase. The more you buy, the more you will donate. Each Retailer specifies the percentage they are willing to contribute to our Charities, meaning that the Thank You Fee will be different depending on the Retailer you choose and, occasionally, on the date of your Purchase (if the Retailer has offered a Thank You Fee increase to Charitable Shopping).
You will be able to see how much each Retailer has agreed to contribute as a Thank You Fee by referring to their dedicated web page on our Website.
Typically, the Thank You Fee will not be calculated taking into account VAT or delivery charges.
While we will do our best to ensure that the Thank You Fee percentages displayed on our Website are correct, they are subject to change and we will not be held liable for any error in this regard. In addition, we cannot be held responsible if the Thank You Fee paid to a Charity is not what you expect.
Retailers usually pay us the Thank You Fee within 120 days of your Purchase being confirmed as successful. Where a Retailer has granted you a refund or a reversal in relation to a Purchase, a Thank You Fee will not be payable to us or to a Charity. We are entirely beholden to the Retailer when they pay the Thank You Fee, and therefore this is entirely outside of our control.
Within approximately 90 days of us receiving the Thank You Fee from a Retailer, we will pay 100% of the amount advertised on our Website to your nominated Charity. We will also receive an amount from the Retailer (in addition to the advertised amount) for reasonable administrative costs and overheads. In addition, Charitable Shopping is social enterprise and therefore all surplus profit is donated to our nominated Charity.
- Retailer Rules
In some cases, a Retailer may have their own rules regarding the eligibility of your Purchase and the associated Thank You Fee. We have no control over these rules but you should be aware that they apply.
- My Renewals and Upgrade
You may use the Renewals and Upgrade tab on our Website to get a free automated reminder when your insurance and other contracts are due for renewal or upgrade. Along with a reminder, we will also send you a link to some of our affiliated Retailers who have agreed to pay a Thank You Fee to allow the contribution to your chosen Charity.
By signing up for this service, you agree to receive the communications and reminders mentioned above. You may elect through the same tab on our website to stop receiving such reminders at any time.
- Your Responsibilities to Charitable Shopping
In order to track your Purchase for purposes of generating the Thank You Fee, you will need to ensure that you have turned your cookies “on” when browsing our Website.
You agree that you will not use, copy, or adapt any content or information made accessible to you on our Website without our express written permission.
You confirm that you will not use or manipulate the content of our Website in pursuit of fraudulent or criminal endeavours.
You must inform us of any changes to any personal information you have provided us with.
It is your responsibility to keep your log-in and Account details safe and secure. If you choose to share your log-in or Account details with a third party, we exclude all liability for any claims, losses or damage caused to you as a result.
- Charitable Shopping’s Obligations to You
We are a registered social enterprise with an altruistic outlook and we promise that any Thank You Fees we receive will be dealt with honestly and in accordance with these Ts&Cs.
Charitable Shopping, at all times acts, as an affiliate of the Retailers and cannot be held responsible for fulfilling any of the contracts you have concluded with the Retailers in respect of your Purchases.
We do not control the content of any of the Retailers’ websites and we cannot accept any responsibility for such content.
- Your Relationship with Retailers
Your Purchase of a Retailer’s products or services through their online shops forms a contractual relationship between you and the Retailer. Charitable Shopping is not party to this contract and is not responsible for any issue, fault or defect in any product or service you have Purchased from a Retailer.
- Use of Thank You Fee by Charities
Each Charity reserves the right to utilise the Thank You Fees paid to it for any purpose they deem fit. Charitable Shopping has no control over the manner in which the Thank You Fee is used once it is paid to a Charity and cannot be held responsible for any misuse of funds in this regard.
- Data Protection
In order to facilitate the calculation of the Thank You Fee and the operation of our Website in general, we make use of cookies and other technologies.
For more information on how we use cookies and deal with your personal data in general, please refer to our Privacy Policy and our Cookies Policy.
We are not responsible for any failure of any cookies (or other technologies) to record your transactions and generate the payment of the Thank You Fee to any Charity.
We promise that we will not unnecessarily transfer any of your personal data to any third parties not disclosed in our Privacy Policy or Cookies Policy and to always comply with relevant data protection legislation.
- Breach
We reserve the right to, at our absolute discretion, immediately suspend or close your Account and/or withhold payment of all Thank You Fees to any of our Charities if we suspect (or have actual knowledge) of your breach of these Ts&Cs and/or of any fraudulent or criminal activity you have undertaken in your use of our Website or in relation to your Purchase.
Limitation of Liability
Our total aggregate liability to you is limited to the higher or i. the total amount of Thank You Fees paid by us to a Charity on your behalf or ii. £50.
We cannot be held liable whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation (whether innocent or negligent), restitution or otherwise for any loss of profits, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss, or for any special, indirect or consequential loss costs, damages, charges or expenses however arising under these Ts&Cs.
Nothing in these Ts&Cs limits any liability which cannot legally be limited, including liability for death or personal injury caused by our negligence and/or any fraudulent conduct by us.
- Questions or Disputes.
If you have a query regarding these Ts&Cs, your Thank You Fee and/or or any of our Charities, please feel free to contact us through our website using support ticket system https://charitable.shopping/support-ticket/.
Since your Purchase is made directly with a Retailer, we will not be able to assist you with any Purchase-related queries or disputes. We are not responsible for any refunds or exchanges. If you have a query in this regard, you should contact the Retailer directly.
- Amendment
We reserve the right to amend these Ts&Cs, our Privacy Policy and/or our Cookies Policy at any time. We will do our best to inform you of any significant changes by way of an announcement on our Website but it is your responsibility to regularly check these documents.
- General
Governing law. These Ts&Cs, our Privacy Policy and our Cookies Policy are governed by the laws of England and Wales. We will do our best to solve any disputes arising in connection with these Ts&Cs, our Privacy Policy and our Cookies Policy in a quick, friendly and efficient manner. However, if you wish to commence court proceedings, you must do so in the courts of England and Wales.
Force Majeure. In the occurrence of an event beyond our control which affects our ability to perform under these Ts&Cs, we will be fully excused from performing our obligations and will have no liability to you in this regard.
Transfer of obligations. You may not transfer any of your rights or obligations under these Ts&Cs to any other person. We reserve the right to transfer or assign our rights and obligations, in whole or in part, to any person (without your consent).
No Waiver. If we decide not to exercise or enforce any right that we has against you at a particular time, this does not prevent us from later deciding to exercise or enforce that right.
Third Party Rights. For the purposes of the Contracts (Rights of Third Parties) Act 1999 these Ts&Cs are not intended to, and do not, give any person who is not a party to them any right to enforce any of its provisions.
Severability. If any provision in in these Ts&Cs are considered illegal or unenforceable by a court, such provision will be modified as necessary. If this is impossible, the provision will be deleted and all other provisions of these Ts&Cs will remain in full force and effect.
No Partnership / Joint Venture / Agency. These Ts&Cs do not create a partnership, agency relationship joint venture of any kind between you and Charitable Shopping. Neither party has any authority to make any commitments on the other party’s behalf.
Entire Agreement. These Ts&Cs, our Privacy Policy and our Cookies Policy is the whole and entire agreement concluded between Charitable Shopping and you. All other agreements, understandings or arrangements are excluded.
